$28 Million Divorce Case to Change NZ Trusts

by admin on September 4, 2015

A landmark divorce case in New Zealand began this week, and is likely to change the way trusts are constructed, reports the New Zealand Herald.

Earlier this year a top lawyer said that the case had completely changed the law in this area.

Melanie Clayton claims she has rights to half of former partner Mark Claytons fortune. Mark has considerable sawmilling interests as well as other assets caught up in a number of companies and trusts.

He argues that the trust assets are not relationship property, whereas she feels she is entitled to half their worth.

Divorce lawyers in Thailand Chaninat and Leeds are experts in handling divorce cases successfully on behalf of their clients, be they Thai nationals or foreigners in Thailand.

Her valuer says that if her view is upheld, she could be due half the assets at an estimated value of over $28 million.

The couple separated 10 years ago, following a 17 year marriage. They have already been through the Family Court, High Court and Court of appeal.

The case will develop this week in Wellington.
